Broompark, Liberton - Terms and Conditions

Terminology

The expression ‘the Client’ or ‘the Tenant’ shall mean the person making the booking and all members of the rental party who have been accepted by the Owner [Linda Patmore] of the Property [101 Liberton Drive, Edinburgh, EH16 6TH]. Vacation Rentals Scotland Ltd act as agents for the Owner of the Property. The agreement for 101 Liberton Drive, Edinburgh, EH16 6TH is between Client and Owner.

Liability

The Owner shall not be liable to the Client or third parties for any accident, damage, loss, injury, expense or inconvenience unless where otherwise stated which may be suffered, incurred, arise out of or in any way be connected with the rental of the Property. If the Property becomes unavailable or unusable for some reason prior to or during the rental period then the Owner's obligation will be to reimburse the Client for all monies paid in respect of the former and the relevant proportion of monies paid for the outstanding rental period in the event of the latter. The Owner or acting agent/s will determine whether the Property is usable or not.

Occupancy

The Client undertakes not to exceed the number of occupants of the Property as previously agreed in writing with the Owner as part of the rental agreement. The Owner reserves the right to end the rental agreement immediately if this condition is not observed. The Owner and his/her acting agent/s reserve the right to refuse entry to any person who, in the opinion of the Owner or his/her acting agent/s, is not suitable to take charge. The Property is occupied strictly on the basis that the accommodation is for holiday use only and that no right to remain in the Property after the end of the holiday period booked exists for the Client or for any other person or persons who occupy the Property. The Client will provide a list of names of guests and the ages of any guests under 25 years of age.

Deposits and payments

A non-refundable down payment of 25% is payable on booking with the balance payable 6 weeks in advance of the arrival date. If a booking is made less than 6 weeks before the arrival date, the full rental is payable at the time of booking. Payments are non-refundable, and the Client should take out appropriate travel insurance to cover the rental in case of cancellation by the Client. At the same time as the balance, a good-housekeeping deposit of £150 or 10% of the rental cost (whichever is greater) is payable, which will be returned to the Client in full after the rental period minus any deductions for breakages or damages. When the balance of the rent is paid, final details of the Property, with arrival and entry information, will be forwarded to the Client.

Services, including cost of fuel

The rent of the property includes rates, local taxes, charges for gas, electricity, heating oil and water supplied to the property, and the use of pots, pans, glasses, crockery, cutlery, bed linen and towels for the duration of the rental. The rental rates include power usage at reasonable amounts, understood as up to £20 per week in total for gas, electricity and heating oil combined unless otherwise specified in the booking documentation. This amount is usually sufficient to cover costs. Rentals longer than 2 or 3 weeks may be arranged at a rate excluding utility bills. Any excess power usage, and utility bills for longer rentals, are charged at cost price.

Holding reservations

Once Vacation Rentals Scotland Ltd has confirmed your booking, please email us within 4 days to confirm that you have made your payment (i.e. made a PayPal payment or set up an electronic bank transfer), otherwise we may not be able to continue to hold your reservation.

Care of the property

The Client shall take all reasonable and proper care of the Property and its contents in or on the Property and leave them in the same state of repair and condition and in the same clean and tidy condition at the end of the rental period as at the beginning. The Owner is not responsible for any loss or damage to the Client's goods or personal belongings in the Property.

Nuisance

The Client shall not cause a nuisance of any kind. The property is not suitable for party/hen/stag breaks. If the Client is part of a party/hen/stag group, you must let us know and we will suggest an appropriate property. The Owner reserves the right to cease the tenancy in the event of complaints.

Complaints

Should the Client have any cause for complaint during the occupation of the Property it must be notified promptly to the Owner or acting agent/s and in the case of serious problems confirmed in writing. If the Owner receives complaints from occupants of neighbouring properties about a Client's behaviour during the term of the rental agreement, the Owner reserves the right to end the agreement at any time.

Breakages or damage

The Client is liable to reimburse the Owner for the cost of replacement, repair or extra cleaning which may exceed the good-housekeeping deposit.

Children

Children staying in the Property must be carefully supervised at all times, particularly in and around the house, especially on stairs, on balconies and terraces, around window areas, in common stair areas, and in other common areas. Children must be carefully supervised particularly in areas that are above ground-floor level. If you have children in the Property, please avoid using felt pens and wax crayons, since we may have to charge for any cleaning costs.

Arrival and departure

The rental period starts at 4.00pm on the day of arrival and ends at 10.00am on the day of departure unless otherwise agreed in writing between the Owner or his/her acting agent/s and the Client.

Right of entry

The Owner or his/her acting agent/s shall be allowed the right of entry to the Property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.

Jurisdiction

The Tenant warrants that the Property let is to be used for the purposes of a holiday and so accepts that the letting is a holiday let to which paragraph 6 to Schedule 1 of the Private Housing (Tenancies) (Scotland) Act 2016 applies, namely, a tenancy the purpose of which "is to confer on the tenant the right to occupy the let property for a holiday." The Tenant shall be entitled to occupy the Property for holiday purposes only and this agreement shall not confer on the Tenant any security of tenure within the terms of the Housing Act 1988 pursuant to which the occupation shall be deemed to be by way of an excluded tenancy. Agreement between the Owner and the Client is subject to Scottish Law. Any dispute between the parties will be heard in the Courts of Scotland.

Smoking

Smoking is not permitted in the Property.
For the comfort of future guests smoking is not allowed

Acceptance of terms

Confirmation of a booking by the Owner or his/her acting agent/s will be deemed to be an acceptance by the Client of these conditions and a confirmation of the details and conditions supplied at the time of booking.

Privacy Statement: Using your personal information

We use any personal details that you give us only to process your own booking. We do not store credit card details, because these are processed independently by PayPal. We do not pass any personal details of our customers to third parties. All personal information is collected, held and used in compliance with the General Data Protection Regulation. We have an email mailing list and send an update email in December, with occasional extra emails during the year for those who have signed up to this (you can sign up via vacation-rentals-scotland.com/subscribe).
